Distance Selling Agreement
This contract has been prepared based on the obligation to make a contract for sales made over the internet in accordance with the Regulation on Distance Contracts published in the Official Gazette dated 06.03.2013 and numbered 27866, and its articles are as follows.
ARTICLE 1 – SUBJECT
The subject of this contract covers the rights and obligations of the parties in accordance with the provisions of the Law on Consumer Protection No. 6502 published in the Official Gazette dated 28.11.2013 and numbered 28835, and the Regulation on Distance Contracts published in the Official Gazette dated 06.03.2013 and numbered 27866, regarding the sale and delivery of the product sold by the SELLER to the BUYER.

ARTICLE 2.2 – BUYER INFORMATION
The person who is a member of erayman.com as a customer. The title, address and contact information declared by the customer while becoming a member are taken as basis.
ARTICLE 3 – PRODUCT INFORMATION SUBJECT TO THE CONTRACT
The type, quantity, brand/model, color, number, sales price, payment method of the goods/products/service consist of the information at the time the order is finalized.
ARTICLE 4 – GENERAL PROVISIONS
4.1 – The BUYER is deemed to have read the basic characteristics, sales price and payment method of the contracted product or products specified in Article 3 and all preliminary information regarding delivery carefully, completely and from beginning to end, understood its content and approved its provisions, and hereby fully and in advance accepts, declares and undertakes that it has given the necessary confirmation electronically.
4.2 – The contracted product or products exceed the legal 30-day period. provided that it does not exceed the specified time for each product, it will be delivered to the BUYER or the person/institution at the address specified by the BUYER within the period specified in the preliminary information depending on the distance of the BUYER’s place of residence. This period may be extended for a maximum of 10 days, provided that the BUYER is notified in advance.
4.3 – If the product subject to the contract is to be delivered to a person/institution other than the BUYER, Erayman Tekstil Makine Sanayi Ticaret Limited Şirketi cannot be held responsible if the person/institution to which the delivery will be made does not accept the delivery.
4.4 – Erayman Tekstil Makine Sanayi Ticaret Limited Şirketi is responsible for the delivery of the product subject to the contract in a sound, complete manner, in accordance with the qualifications specified in the order and with the warranty documents and user manuals, if any.
4.5 – The delivery of the contractual product must be made with the payment method preferred by the BUYER. If the product price is not paid for any reason or is canceled in the bank records, Erayman Tekstil Makine Sanayi Ticaret Limited Şirketi shall be deemed to have been relieved of its obligation to deliver the product.
4.6- If the relevant bank or financial institution does not pay the product price on behalf of Erayman Tekstil Makine Sanayi Ticaret Limited Şirketi due to the unfair or illegal use of the BUYER’s credit card by unauthorized persons for a reason not caused by the BUYER’s fault after the delivery of the product, the product must be sent to the contact address(es) of Erayman Tekstil Makine Sanayi Ticaret Limited Şirketi within 3 calendar days, provided that it has been delivered to the BUYER. In this case, the shipping expenses belong to the BUYER.
4.7- If Erayman Tekstil Makine Sanayi Ticaret Limited Şirketi cannot deliver the contractual product within the due time due to force majeure or extraordinary circumstances such as adverse weather conditions preventing transportation or interruption of transportation, it is obliged to notify the BUYER of the situation. In this case, the BUYER may use one of the following rights: cancellation of the order, replacement of the contractual product with a similar one, if any, and/or postponement of the delivery period until the obstacle is eliminated. In the event that the BUYER cancels the order, the amount paid shall be paid to the BUYER in cash and in a single payment within 10 business days.
4.8- This contract shall become valid at the moment the order is confirmed, accepted and finalized by the BUYER.
ARTICLE 5 – RIGHT OF WITHDRAWAL
The BUYER has the right of withdrawal within 7 days from the delivery of the contractual product to him/her or to the person/institution at the address he/she has indicated. In order to exercise the right of withdrawal, it is required that a notification be made to the communication channels of Erayman Tekstil Makine Sanayi Ticaret Limited Şirketi by e-mail, fax and/or telephone within this period and that the product has not been used within the framework of the provisions of the relevant law in force. In case of using this right, it is mandatory to return the original invoice and a copy of the cargo delivery report stating that the product delivered to the 3rd party or the BUYER was sent to the contact addresses of Erayman Tekstil Makine Sanayi Ticaret Limited Şirketi. The product price will be refunded to the BUYER within 7 days following the receipt of these documents. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be refunded. Due to the right of withdrawal,6- If the relevant bank or financial institution does not pay the price of the product on behalf of Erayman Tekstil Makine Sanayi Ticaret Limited Şirketi due to the unfair or illegal use of the BUYER’s credit card by unauthorized persons for reasons not caused by the BUYER’s fault after the delivery of the product, the product must be sent to the contact address(es) of Erayman Tekstil Makine Sanayi Ticaret Limited Şirketi within 3 calendar days, provided that it has been delivered to the BUYER.
